1. INTRODUCTION, DEFINITIONS, AND OUR PURPOSE

These Terms of Use (“Terms” or “Agreement”) apply to all digital services, mobile applications, websites, interactive features, software, and all related content (“Services”) offered by Sapio (“We,” “Application,” “Platform”). The purpose of these Terms is to establish a legal framework concerning your (“User,” “You,” “Member”) access, use, interaction with the Services, as well as the rights, obligations, liabilities, and potential disputes arising therefrom.

Definitions:

• Services: All functions, features, interfaces, APIs, tools, and platforms offered by Sapio.
• User Content: Text, images, videos, audio, profile information, messages, Q&A, and similar materials uploaded, shared, or created by Members within the Services.
• Our Content: Trademarks, logos, trade names, designs, software, algorithms, code, text, images, and other intellectual property products belonging to Sapio or its licensors.

2. LEGAL RELATIONSHIP BETWEEN THE PARTIES

This Agreement is legally binding between you and Sapio. By using Sapio’s Services, you represent that you understand and accept all policies, guidelines, and procedures. If you do not accept these Terms, do not access or use the Services.

3. ACCOUNT CREATION CONDITIONS AND USER OBLIGATIONS

• Age and Capacity: You must be at least 18 years old to use the Services.
• Criminal Records: You must not have been convicted of sexual offenses or serious violent crimes, and must not appear on any sex offender registry.
• Accurate Information: All information provided during registration must be true, complete, and up-to-date. Providing false or incomplete information may result in suspension or closure of your account.
• Account Security: You are responsible for the confidentiality of your passwords. If you notice unauthorized access or suspicious activity, notify us immediately.

4. SCOPE OF OUR SERVICES, ACCESS, AND USAGE RULES

• The scope of Services may change over time; new features may be added or existing ones removed.
• Access to Services may vary depending on the device, browser, operating system, or geographic location.
• Temporary access restrictions may apply due to technical malfunctions, maintenance, or security reasons.

5. CONTENT POLICY, LICENSES, THIRD-PARTY CONTENT

• Your Content: Users are responsible for all content they create or share on the platform.
• License Grant: Sapio has a royalty-free, worldwide, sublicensable, and transferable license to use any user-generated content for the operation, marketing, development, and analysis of its Services.
• Third-Party Content: Sapio is not responsible for the accuracy, safety, or legality of any content produced by users or third parties. We do not guarantee correctness of non-Sapio team-created content.

6. PREMIUM FEATURES, SUBSCRIPTIONS, PAYMENT, BILLING, REFUNDS, AND TAXES

Premium Subscriptions:

• 1-Week Premium: €14.99/week
• 1-Month Premium: €5.83/week
• 1-Year Premium: €3.99/week

Auto-Renewal: Subscriptions renew automatically before expiration. If not canceled, you will be charged at the current rate.

Payments: All payments are processed through the App Store or Google Play; national or international taxes may apply.

Refunds: Unused jokers, credits, or digital assets are not refunded. Consumer rights remain reserved.

7. DATA PRIVACY, PROCESSING OF PERSONAL DATA, SECURITY, AND COMPLIANCE

• Data Collection: All information/data generated by Sapio users is collected, processed, analyzed, and stored on internationally reliable infrastructures such as Firebase.
• Data Security: Your data is protected with encryption, authentication, and security protocols that meet industry standards.
• International Compliance: We comply with GDPR, CCPA, or similar regulations.
• Legal Requests: Your data may be shared with authorized authorities in accordance with applicable laws.

8. DATA RETENTION, DELETION, ACCOUNT TERMINATION, PERMANENCE, AND IRREVERSIBILITY PRINCIPLE

• Permanent Deletion Upon Request: When you request account deletion, all of your user data (including your profile data, photos, notifications, match history, Q&A, messages, and any other related content) will be permanently and irreversibly removed from our systems. Once deleted, it cannot be recovered.
• Subscriptions and Refunds: If you have an active subscription at the time of deletion, it will end when its current term expires, and no refunds will be provided for any unused period or digital assets. Any remaining credits, jokers, or digital items will also be lost.
• Chat and Interaction Data: Any chat transcripts, user interactions, Q&A, or similar data are also permanently deleted once your account is removed. These records are not retrievable after your account deletion request is processed.
• Sapio reserves the right to anonymize or retain certain non-personal, aggregated data for statistical, security, or product-development purposes. However, this data will no longer be linked to your personal identity once your account is deleted.

Sapio reserves the right to store, process, analyze, and use any kind of data/content produced on the platform (other than personal data) for marketing, product/service development, and administrative decision-making, in accordance with legal frameworks.

9. PROHIBITED CONTENT, CODE OF CONDUCT, VIOLATION DETECTION, AND SANCTIONS

• Prohibited Content: Child exploitation, hate speech, racism, sexism, homophobia, transphobia, harassment, threats, incitement to violence, pornographic content, spam, identity theft, fake accounts, and encouragement of illegal activities are strictly forbidden.
• Violation Detection: Our moderation teams or automated tools may detect violations. In such cases, user profiles may be frozen or automatically deleted. All negative consequences arising from violations belong to the violator.
• Sanctions: In case of violation, warnings, temporary suspensions, or permanent account closures may be applied. Reports to legal authorities may be made.

10. INTELLECTUAL PROPERTY RIGHTS, COPYRIGHT INFRINGEMENT NOTICES, DMCA, AND LEGAL COMPLIANCE

• All trademarks, logos, slogans, advertising campaigns, colors, designs, and sounds belong to Sapio or its licensors.
• Copyright infringement notices will be evaluated according to legal frameworks. Infringing content will be removed, and related accounts may be terminated. Sapio is not liable for damages arising from users’ or third parties’ copyright infringements.

11. DISCLAIMER OF LIABILITY, WARRANTY LIMITATIONS, RISK ACCEPTANCE, AND INDEMNITIES

• Services are provided “as is”; no guarantee is given regarding uninterrupted operation, error-free usage, or fitness for a particular purpose.
• Sapio is not responsible for user content, third-party activities, technical malfunctions, data loss, indirect or incidental damages.
• Users agree to indemnify Sapio against third-party claims, losses, and damages.

12. DISPUTE RESOLUTION, APPLICABLE LAW, CONSUMER RIGHTS, MEDIATION, AND JURISDICTION

• The parties first attempt to resolve disputes in good faith.
• In case of unresolved issues, the courts of the Republic of Turkey have exclusive jurisdiction.
• Mandatory consumer protection provisions remain intact.

13. INTERNATIONAL USE, COMPLIANCE WITH LOCAL LAWS, EXPORT AND IMPORT CONTROLS

• Access from different countries is possible; compliance with local laws is the user’s responsibility. Any resulting damages belong to the user.
• Use that violates international trade, export, and import laws is prohibited.

14. CHANGES, UPDATES, NOTIFICATIONS, REVISION PROCESSES, AND VERSION TRANSITIONS

• These Terms may be changed without prior notice.
• Significant changes are announced via updates on the App Store or Google Play Store, or within the application’s description area.
• Continuing to use the Services after changes indicates acceptance of the new Terms.

15. SEVERABILITY, ASSIGNMENT, WAIVER CONDITIONS, SUCCESSORS, AND ASSIGNS

• The invalidity of any provision does not affect the validity of others.
• Sapio may assign this Agreement in whole or in part. Users may not assign.
• Failure to exercise any right does not mean a waiver of that right.

16. THIRD-PARTY SERVICES, LINKS, ADVERTISEMENTS, PARTNERSHIPS, AND SPONSORED CONTENT

• Services may contain links to third-party websites, advertisements, partners, or sponsored content. Sapio is not responsible for their accuracy, legality, or safety.
• All responsibilities arising from your interactions with third parties belong to you.

17. COOKIES, ANALYTICS TOOLS, ADVERTISING TECHNOLOGIES, AND PERSONALIZATION

• Cookies and similar technologies are used to personalize advertising, measure analytics, and improve user experience.
• Third-party analytic tools (e.g., Google Analytics) may collect usage statistics. The right to store, process, and utilize these data and metrics for decision-making processes belongs to Sapio.

18. FORCE MAJEURE, SERVICE INTERRUPTIONS, OPERATIONAL DIFFICULTIES, CRISIS MANAGEMENT

• War, natural disasters, government actions, pandemics, terrorism, or technical infrastructure collapses may cause interruptions or suspensions in the Services.
• No liability is accepted under these conditions, but reasonable efforts will be made to restore services once normal conditions return.

19. CYBERSECURITY, ANTI-FRAUD MEASURES, TECHNOLOGICAL REQUIREMENTS, AND SYSTEM INTEGRITY

• Any attempt to harm Services, gain unauthorized system access, spread malware, or perform cyberattacks is prohibited.
• In cases of fraud, identity theft, data manipulation, or account takeover attempts, relevant users will be blocked immediately, and legal action may be taken if necessary.
• Access to Services may require specific operating systems, browsers, or device capabilities.

20. RECORD-KEEPING POLICIES, COMPLIANCE WITH LEGAL REQUESTS, AUDITS, AND COOPERATION

• Certain data may be retained for legally mandated durations.
• We respond appropriately to legal audits, investigations, or official requests.

21. NOTIFICATION METHODS, COMMUNICATION, SUPPORT, AND FEEDBACK MECHANISMS

• For support, questions, suggestions, complaints, or feedback, you may use the App Store or Google Play Store review sections, or email contact@sapio.fun.
• No other support channel is provided. Your comments may be reviewed and evaluated to improve service quality.
• Official correspondence or legal notices must be submitted through valid communication methods.

22. EFFECTIVE DATE, DURATION, TERMINATION OF THE AGREEMENT, AND CONSEQUENCES

• This Agreement remains in effect as long as you use the Services.
• You may terminate the Agreement by deleting your account or ceasing to use the Services.
• After termination, relevant legal obligations, retention policies, intellectual property rights, or disclaimers remain in effect.

These Extended and Detailed Terms of Use define the legal framework for using Sapio’s Services and outline the requirements of the relationship between the parties in detail. By continuing to use the Services, you are deemed to have fully accepted these terms and conditions.
